Attributions of the Head of Government according to the constitution

The powers of the Head of Government are fixed in accordance with the Constitution in articles:  91, 92, 93, 94

Article 91: Subject to the provisions of article 77, the Head of Government determines the general policy of the State and ensures its implementation. 

Article 92: Fall within the competence of the Head of Government: 

  • the creation, modification, abolition of the Ministries and Secretariats of State, the determination of their competences and their attributions, after deliberation of the Council of Ministers;
  • the termination of services of one or several members of the Government or the examination of his resignation, and in consultation with the President of the Republic with regard to the Minister of Foreign Affairs or the Minister of Defense;
  • the creation, modification or abolition of the public establishments and public enterprises and administrative departments, as well as the determination of their competences and their attributions, after deliberation of the Council of Ministers, except for those which fall under the Presidency of the Republic whose creation, modification and abolition occurs on a proposal from the President of the Republic;
  • appointments to the senior civilian jobs and their terminations. These jobs are set by law. The Head of Government informs the President of the Republic of the decisions taken within the framework of his aforementioned powers. The Head of Government has the administration and concludes the international treaties of technical nature. The Government ensures the implementation of laws. The Head of Government may delegate some of his prerogatives to Ministers. In the event of temporary incapacity to exercise his functions, the Head of Government delegates his powers to one of the Ministers.

Article 93: The Head of Government presides the Council of Ministers. The Council of Ministers meets at the request of the Head of Government who sets its agenda. The President of the Republic obligatorily presides the Council of Ministers in the fields of defense, foreign relations and national security relating to the protection of the State and the national territory against internal and external threats. The President of the Republic may also attend other meetings of the Council of Ministers and, in this case, he presides the Council. All draft laws are subject to deliberation in the Council of Ministers.

Article 94: The Head of Government exercises the general regulatory power; he enacts the individual decrees which he signs after deliberation of the Council of Ministers. The decrees issued by the Head of Government are called governmental decrees. The decrees of regulatory nature are countersigned by each concerned Minister. The Head of Government has the power of visa of the regulatory orders made by the Ministers.
